The different tax rules between Member Owned and Proprietary Owned clubs has been a major issue for the proprietary sector for a number of years. At GolfBIC 2019, which returns to the Marriott Forest of Arden (pictured above) on 18th March, Paul Stewart from KPMG will provide a brief overview of efforts undertaken by the UKGF (formerly the UKGCOA) to level the playing field on VAT.

After several years of dialogue with The Treasury and HMRC there is no sign of any changes being made to the VAT rules.

Last year, KPMG provided VAT litigation support for Stoke by Nayland who succeeded in the Upper Tier Tribunal having established a separate non-profit making club a number of years ago. The circumstances of Stoke were considered to be distinguishable from the many previous cases which had been unsuccessful in seeking to achieve separation between a landlord and a non-profit making club. Some might say uniquely so.

Paul will summarise the decision and key facts to offer an understanding of why Stoke were successful.
